Terms of Service

1. Scope

These Terms of Service (hereinafter "Terms") apply to all contracts between:

(hereinafter "Provider")

and the customer (hereinafter "User") concluded via the website tryunspoken.com. The Provider offers speech recognition and transcription software (hereinafter "Software").

2. Subject Matter

2.1 The Provider grants the User a non-exclusive, non-transferable license to use the Software in accordance with these Terms.

2.2 The Software is offered in the following versions:

  • Free Trial: 7 days full access without limitations. No credit card required.
  • Subscription (Personal): €8/month or €80/year. First billing occurs after the 7-day trial period. Cancel anytime.
  • Lifetime: One-time payment of €190 for unlimited use on up to 3 devices, including 1 year of free updates.
  • Enterprise: Custom licensing for businesses. Contact us for details.

3. Prices and Payment

3.1 All prices include statutory VAT.

3.2 Subscriptions are billed monthly or annually in advance. Cancellation is possible at any time, effective at the end of the billing period.

3.3 The Lifetime license includes 1 year of free updates. After that, updates can optionally be purchased for €25/year.

3.4 Payment is processed through Stripe. Their terms of service also apply.

4. Right of Withdrawal (EU Consumers)

4.1 EU consumers have the right to withdraw from this contract within 14 days without giving any reason.

4.2 The withdrawal period is 14 days from the day of contract conclusion.

4.3 To exercise the right of withdrawal, the User must inform the Provider of their decision by a clear statement (e.g., email to info@tryunspoken.com).

4.4 In case of a valid withdrawal, all payments will be refunded immediately and at the latest within 14 days.

4.5 For digital content, the right of withdrawal expires once contract performance has begun and the User has expressly consented.

5. License Rights

5.1 The User receives the non-exclusive right to install and use the Software on the licensed number of devices.

5.2 The User may not:

  • Resell, rent, or lend the Software
  • Decompile, reverse engineer, or modify the Software
  • Use for illegal purposes
  • Transfer or assign to third parties
  • Publicly share license keys

6. Warranty and Liability

6.1 The Software is provided "as is". The Provider makes no guarantee of uninterrupted or error-free operation.

6.2 The Provider's liability for slight negligence is excluded unless essential contractual obligations (cardinal duties) are affected.

6.3 Liability for damages from injury to life, body, or health, as well as for intentional or grossly negligent breaches of duty, remains unaffected.

6.4 Liability is in any case limited to the purchase price paid by the User in the last 12 months.

7. Data Privacy

7.1 Processing of personal data is carried out in accordance with our Privacy Policy at tryunspoken.com/privacy.

7.2 Speech processing takes place entirely locally on the User's device. No audio data is transmitted to our servers.

8. Updates and Support

8.1 The Provider provides updates and improvements at their own discretion.

8.2 For subscriptions, all updates are included in the price.

8.3 For Lifetime licenses, updates are included for 1 year from purchase date. After that, updates can optionally be purchased for €25/year.

8.4 Support is provided via email at info@tryunspoken.com.

9. Termination

9.1 Subscriptions can be cancelled at any time, effective at the end of the current billing period, via the customer portal or by email.

9.2 Lifetime licenses have no term limit and cannot be terminated.

9.3 In case of violation of these Terms, the Provider may terminate the license with immediate effect.

10. Final Provisions

10.1 The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.

10.2 For consumers within the EU, mandatory consumer protection laws of their country of residence also apply.

10.3 The place of jurisdiction for merchants is Bremen, Germany.

10.4 Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
